Our conditions

The services of JF Courtier en Vins are guaranteed to comply with the rules and code of ethics governing French wine and spirits brokers.
Our conditions are set out in the attached PDF document entitled “General Conditions of JF Courtier en Vins Sarl.”
Our mission is to bring buyers into close contact with the world of wineries and to put sellers in touch with real markets. In doing so, we respect the traditions and customs of the various appellations of origin, mutual consideration practices specific to each sales channel, and agreements overseeing exclusivity and relations between stakeholders on local, national and international markets.
Our rate of commission, which is set in agreement with the buyer and seller, is determined by the type of market involved.
We are committed to respecting a strict confidentiality policy with every deal.
Remuneration for our expertise is governed by a fee scale based on payment standards applicable to sworn brokers

General Conditions of JF Courtier en Vins Sarl:

  • JF Courtier en Vins is invested by law with a mandate to serve the interests of both parties.
Consistent with standard practice, a deal is deemed to be final and definitive when the Broker has established agreement between the Seller and the Buyer concerning the wines being sold, the negotiated price and the terms of payment and pickup.
  • A letter of confirmation signed by JF Courtier en Vins completes the deal and commits the parties to fulfill all the stipulated conditions, except in the case of an error or omission, which the parties must report within 24 hours of receiving the letter.
  • The duty of JF Courtier en Vins to provide information about the legal capacity of each party terminates with the drafting of the letter of confirmation, after which the Seller is responsible for taking the appropriate steps to secure payment guarantees.
  • Under the terms of this agreement, at no time shall the signature of JF Courtier en Vins on the letter of confirmation be construed in any way as a joint commitment or an undertaking of responsibility in the event of a default by one of the parties.
  • The brokerage fee is due on the date of the contract, whatever the nature of the agreement.
  • The office of JF Courtier en Vins is entitled to the entire brokerage fee even if the signed agreement is not completed by the parties, insofar as the firm has negotiated an agreement between the parties and has committed no fault.
  • Except in the case of wrongful conduct, no incident that may occur during execution of the deal (refusal of goods, withdrawal of goods, failure to make payment, etc.) shall retroactively affect the principle and the amount of the brokerage fee.
  • In accordance with section 1587 of the Civil Code, a sale is deemed to be final when the wine has been approved by the Buyer.
  • The Seller is responsible for ensuring that the wine sold is identical with the samples submitted to and accepted by the Buyer. The Seller must also scrupulously ensure that the tankers or trucks are loaded with the same wines.
  • Unless otherwise specified, the Buyer is responsible for the arrangements and cost of the pickup.

Unless otherwise specified, the parties mandate JF Courtier en Vins to invoice and to receive payment on behalf of the Seller.
